Terms of Service

Effective: September 10, 2026 Includes End User Licence Agreement Android & iOS

These Terms of Service (the "Terms"), which include an End User Licence Agreement, govern your use of the Car Catalog mobile application for Android and iOS and the website at carcatalog.app (together, the "Service"), operated by the Car Catalog team ("we", "us").

Zero tolerance. The Service allows users to upload photographs. We have no tolerance for objectionable content or abusive behaviour. Content that breaches section 6 is removed and the responsible user loses the ability to upload — see sections 7 and 9.

1. Acceptance of These Terms

By downloading, installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you upload a photograph, you additionally accept the upload terms shown to you at that moment. We record which version of those terms you accepted, so that it is always clear what you agreed to for each photograph.

2. Eligibility

You must be at least 13 years old to use the Service, and at least the age of digital consent in your country if that age is higher. If you are under 18, you may use the Service only with the involvement of a parent or guardian.

Browsing the catalogue requires no account. Uploading photographs and sending reports are open to users who meet the age requirement above.

3. What the Service Is

Car Catalog is a reference catalogue of vehicle brands, models, generations and technical specifications, together with automotive news and user-contributed photographs.

The catalogue is reference information, not advice. Specifications are compiled from public and third-party sources and may be incomplete, out of date or wrong. Do not rely on them for a purchase, a repair, an insurance claim or any decision with financial or safety consequences. Verify with the manufacturer or a qualified professional.

We may add, change or remove features at any time. We do not guarantee that the Service will be available without interruption.

4. Licence to Use the Application

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Application on devices you own or control, for your own non-commercial use, in accordance with these Terms and the rules of the app store you obtained it from.

You may not:

  • copy, modify, translate or create derivative works of the Application
  • reverse engineer, decompile or disassemble it, except where that right cannot lawfully be excluded
  • rent, lease, sell, sublicense or otherwise transfer it
  • remove or obscure any proprietary notice

The Application does not require you to create an account. Instead, your installation is identified by a random identifier generated by our server. That identifier — and the favourites, history and uploads associated with it — is tied to the installation, not to you, and is lost when you uninstall.

5. Content You Upload

"Your Content" means photographs and any text you submit through the Service, including reports and feedback.

5.1 You keep ownership

You retain all rights you already have in Your Content. Nothing in these Terms transfers ownership to us.

5.2 The licence you grant us

By uploading, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt (including resizing, re-encoding and removing metadata), publish, display and distribute Your Content within the Service and in materials promoting the Service.

This licence exists so that we can technically operate the Service — a photograph cannot be shown to other users without it. It ends when Your Content is removed, except for copies retained as described in section 7 and in the Privacy Policy, and except where the content has already been included in materials distributed before removal.

5.3 What you promise

By uploading, you confirm that:

  1. You took the photograph, or you have the rights to it. Photographs copied from manufacturer sites, dealer listings, forums, social media, stock libraries or other apps are not yours to give, even if freely accessible.
  2. It does not infringe anyone's rights — copyright, trademark, privacy, publicity or otherwise.
  3. Any identifiable person in it has consented to its publication.
  4. It complies with the content standards in section 6.
  5. It is accurate — the photograph shows the vehicle you attached it to.

5.4 Metadata is removed

We strip metadata, including GPS coordinates, from every uploaded photograph before storing it. This is a protection for you, not a service we guarantee: you remain responsible for what is visible in the image itself, such as a licence plate, a house number or a face.

5.5 Withdrawing a photograph

You may withdraw a photograph you uploaded at any time from within the Application, using the management key it holds for you. Withdrawal removes it from public view immediately. Files are deleted after a 30-day grace period; the moderation record is retained as described in section 7.

6. Content Standards

These standards apply to everything you submit — photographs, report comments and feedback.

Do not upload content that:

  • is not a photograph of a vehicle, or does not show the vehicle it is attached to
  • is sexual, pornographic or sexually suggestive
  • depicts, encourages or glorifies violence, self-harm, cruelty or terrorism
  • is hateful, harassing or discriminatory on any basis, including race, ethnicity, nationality, religion, disability, sex, gender identity or sexual orientation
  • depicts or exploits minors in any inappropriate way
  • contains illegal content or promotes illegal activity, including illegal street racing
  • discloses someone's personal information without their consent — faces, licence plates identifying a private individual, house numbers, documents
  • infringes copyright, trademark or any other right
  • is spam, advertising or a sale listing, or contains watermarks, contact details, phone numbers or promotional overlays
  • is deliberately misleading — mislabelled, digitally altered to misrepresent a vehicle, or attached to the wrong entry
  • contains malware or is technically crafted to disrupt the Service

Reports and feedback must be made in good faith. Deliberately false reports, abusive language and mass-filed complaints are themselves breaches of these standards.

7. Moderation and Removal

Nothing is published automatically. Every uploaded photograph is reviewed by a person before it becomes visible to anyone else. This is how objectionable content is filtered out — it never appears in the first place.

We may remove or refuse any content at our discretion, with or without notice, including content that is merely unsuitable rather than prohibited. We are not obliged to publish anything you submit.

When a photograph is rejected you are told the reason. When it is approved, and if you have enabled notifications, you are told that too.

Records we keep after removal

When content is rejected or withdrawn, the image files are deleted after 30 days but the record is retained without the image. This is deliberate: the record holds the fingerprint that prevents the same content being re-submitted, the reason given to the uploader, and — if the content was ever the subject of a complaint — the case file that a legal claim may depend on.

8. Reporting Content and Abuse

Every photograph in the Application can be reported from the screen it appears on, and every catalogue entry can be reported for factual errors. You can also send general feedback with no particular subject.

  • In the Application — use the report action on the photograph or catalogue entry.
  • By email[email protected], for anything that does not fit a report form.

We aim to review reports of objectionable content within 24 hours and to act on them by removing the content, ejecting the user who provided it, or both. Reports are handled oldest first. Reports about photographs require a name and email address so that we can reply, particularly where the report is a copyright claim.

You will be notified of the outcome of a report you filed, if you have notifications enabled.

9. Enforcement and Appeals

Where content breaches these Terms, we may take one or more of the following steps, proportionate to what happened:

  1. Remove the content.
  2. Suspend uploading for the device involved — temporarily, as a cooling-off period, or indefinitely. The rest of the Application keeps working, including the ability to browse and to report content.
  3. Block the device entirely from the Service, for serious or repeated breaches.

We record who made each decision, the reason for it, and when it was lifted.

Appeals. If you believe a decision was wrong, write to [email protected] with your device identifier, which the Application shows in its settings. We will review the decision and reply.

11. Prohibited Use of the Service

You must not:

  • access the Service other than through the Application, or use automated means to scrape, crawl or bulk-download the catalogue
  • interfere with the Service or attempt to circumvent rate limits, authentication or moderation
  • impersonate anyone, or misrepresent your connection to a person or organisation
  • attempt to identify other users from content or data in the Service
  • evade an upload suspension or device block, including by reinstalling the Application to obtain a new identifier
  • use the Service for anything unlawful

12. Catalogue Data and Intellectual Property

The Application, its design, its source code and the compilation of the catalogue are ours or our licensors', and are protected by intellectual property law. These Terms grant you no rights in them beyond the licence in section 4.

Vehicle names, model names, logos and trademarks belong to their respective manufacturers. They appear in the Service for identification and reference only. We are not affiliated with, endorsed by or sponsored by any vehicle manufacturer.

Some catalogue images are supplied by manufacturers under press or media terms and remain subject to those terms. News content links to and quotes third-party publishers, who retain their rights.

13. Advertising, Premium and Purchases

The Service is ad-supported. Advertisements are served by Google AdMob and are not selected or endorsed by us. We are not responsible for the content of advertisements or for anything you obtain from an advertiser.

Premium

Premium removes advertising from the Application. It does not unlock catalogue content and does not affect anything outside the Application.

  • Plans. A weekly subscription, a monthly subscription, or a one-time lifetime purchase. Exact prices, in your local currency, are shown by Google Play or the App Store before you confirm.
  • Payment. Purchases are processed by Apple or Google under their terms. We never receive your payment details.
  • Automatic renewal. Subscriptions renew at the end of each period at the price shown in the store, until cancelled. You may cancel at any time in your Google Play or App Store subscription settings; Premium then stays on until the end of the paid period. Uninstalling the Application does not cancel a subscription.
  • Billing problems. If a renewal payment fails, the store retries it for a limited grace period during which Premium remains active; if payment still fails, Premium ends until you update your payment method.
  • Lifetime purchase. A one-time payment that never renews. Buying it while a subscription is active does not cancel that subscription — cancel it yourself in the store to avoid being charged twice.
  • Refunds. Refunds are decided by the relevant store under its rules, not by us. When a store refunds or revokes a purchase, Premium ends immediately.
  • Where Premium works. A purchase is linked to the device that made it and, once accounts are available in the Application, to your account. «Restore purchases» brings Premium back after a reinstall on the same store account. A purchase can be held by one owner at a time; if it is ever moved to another account, the previous owner loses it.
  • Our failures. If Premium is unavailable for a material period because of our fault, contact us and we will extend or restore it. We do not otherwise issue partial refunds ourselves.
  • Misuse. We may withdraw Premium obtained through fraud, chargeback abuse or in breach of these Terms.

14. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free or secure, that defects will be corrected, or that catalogue data is accurate or complete. Content uploaded by users is not ours and we do not endorse it.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profits, data, goodwill or other intangible losses arising from your use of the Service — including any decision you make in reliance on catalogue data.

Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 50.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify us against claims, damages and reasonable legal costs arising from Your Content, from your breach of these Terms, or from your infringement of anyone's rights.

17. Suspension and Termination

You may stop using the Service at any time by uninstalling the Application. We may suspend or terminate your access, in whole or in part, if you breach these Terms or if we reasonably believe your use harms the Service or other users.

Sections that by their nature should survive termination do so — including sections 5.2, 12, 14, 15, 16 and 20.

18. App Store and Google Play Terms

If you obtained the Application from the Apple App Store, the following applies:

  • These Terms are between you and us, not with Apple. Apple is not responsible for the Application or its content.
  • Apple has no obligation to provide maintenance or support for the Application.
  • If the Application fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation.
  • Apple is not responsible for addressing claims relating to the Application, including product liability, regulatory non-compliance and consumer protection claims.
  • Apple is not responsible for investigating or resolving third-party claims that the Application infringes intellectual property rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You confirm you are not located in a country subject to a US Government embargo or designated as supporting terrorism, and are not on any US Government list of prohibited or restricted parties.

If you obtained the Application from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these Terms.

19. Changes to These Terms

We may update these Terms. The effective date at the top of this page shows the current version, and material changes will be announced in the Application before they take effect. Continued use after a change takes effect constitutes acceptance.

Where the upload terms change, you will be asked to accept the new version the next time you upload; photographs already uploaded remain governed by the version you accepted at the time.

20. Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. Disputes are subject to the jurisdiction of the courts of Ukraine.

If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction with mandatory consumer protection rules, this does not deprive you of the protection of those rules or of the right to bring proceedings in your country of residence.

If any provision of these Terms is held unenforceable, the remainder stays in force.
